Terms and Conditions

Terms and Conditions between Peter Burke t/a PGB Photography and clients booking wedding, corporate & event photography with the aforementioned, hereafter referred to as the photographer. By making a payment for a service you are hereby agreeing to these terms and are hereafter referred to as the client.

 It is agreed that the following terms set out the total agreement between the parties & that no variation or modification of this contract shall be effective unless agreed by both parties in writing. Cancellation i, £150 of any deposit is non refundable in the event of a client cancellation. ii, A cancellation / postponement can only be accepted by the photographer from the client in writing. iii, The photographer may cancel this agreement/contract in writing & all monies received shall be refunded in fullto the client. Copyright i, Unless agreed in writing, copyright of images taken by the photographer are protected under the Copyright & Design Act 1988 & may not be reproduced or copied without the consent of the photographer. ii, Digital negatives are typically held for 3 years by the photographer although this time period can not be guaranteed. Display i, The client hereby allows the photographer to display their image in his studio, portfolio, website, other advertising literature but will make no use of the images for other commercial activities without the consent of the client. Force Majeure / Act of God i, The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Image Quality i, the photographer will provide prints with a pleasing colour balance but can not guarantee exact colour matching due to anomalous reflectants caused by a combination certain dyes & materials and the effect that light has upon them Licence i, the photographer shall be granted artistic licence in relation to poses, locations used, cropping, the images selected for printing in black & white and the photographer’s judgment shall be deemed correct. ii, From the images recorded, the photographer may discard those that he decides are unflattering or unsuitable and his judgment shall be deemed correct. iii, Due to vagaries of weather, willingness of subjects, officiating persons, obstructed views, availability of light and limited locations, it may not be possible to capture all images requested. iv, If the client requests specific poses or people to be recorded, they should be listed on this form under ‘any special notes’ or on a separate sheet and the photographer will make reasonable effort to record them but this service can not be guaranteed.  v, The client is advised to view the photographer’s portfolio before booking his services Retouching  i, Images are subject to minimal digital manipulation as they are a factual and photographic record of people and the scenery on the day, so any alteration that the client requires to a finished print or digital image is chargeable. Limitation of Liability i In the very unlikely event of total photographic failure or cancellation of contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract / package. Neither party shall be liable for indirect or consequential loss. Delivery i, The photographer can not be held responsible for any damage/loss to albums or photographs after supply ii, Albums/prints remain property of the photographer until paid for in full. iii, Any discrepancies or damaged product received by post or courier needs to be reported to the photographer with 7 days of receipt. iv, Albums / Books as part of a package must be ordered within 3 years otherwise a surcharge to reflect manufacture & material increases may be levied.  Complaints i, Complaints of any nature should be received in writing by the photographer within 7 days of delivery or collection of prints/ images. ii, The photographer can not accept refunds or credits against photographic prints or digital images supplied on Cd but will replace either if a fault develops within 28 of payment.

Terms and Conditions for Portrait / Studio / Location photography

When placing an order you must be completely happy with your decision as prints / digital files on Cd / DVD / memory stick can not be refunded or exchanged unless a technical fault is evident within 14 days of taking delivery.
